1. SCOPE AND DEFINITIONS

These Terms and Conditions govern all sales, orders, and architectural wellness placements (including but not limited to saunas, hammams, pools, and wellness accessories) completed via the website www.issgard.com or through direct corporate invoices issued by AXAR OÜ (trading under the brand name ISSGARD), to both professional clients (B2B) and private consumers (B2C) globally.

2. ROLE OF ISSGARD & ANONYMOUS MANUFACTURER WARRANTIES (THE SECRET SHIELD)

• Bespoke Design & Engineering: ISSGARD operates as a premium architectural wellness house, designer, and exclusive distributor. The physical components, cabins, and technical units are engineered and manufactured to our high-luxury standards by our exclusive, confidential certified European Industrial Manufacturing Partners.
• Exclusion of Manufacturing Liability: AXAR OÜ cannot be held directly responsible for any structural defects, mechanical errors, or material degradation originating from the assembly lines of its confidential manufacturing partners.
• Warranty Enforcement: All equipment sold by ISSGARD is backed by the official international warranties provided by our respective manufacturing partners. In the event of a mechanical or structural failure, ISSGARD will fully manage the customer service claim and enforce the manufacturer’s warranty on behalf of the Client. However, AXAR OÜ shall bear zero direct financial liability for the manufacturer’s internal industrial errors.

3. INSTALLATION, COMPLIANCE, AND SITE PREPARATION

• Client’s Local Responsibility: ISSGARD delivers ultra-high-end equipment directly to the Client’s delivery address. Unless a specific, separate contract for turnkey installation is signed by an authorized representative of AXAR OÜ, installation, assembly, plumbing, and high-voltage electrical connection are the exclusive responsibility of the Client.
• Certified Professionals Only: The Client is legally required to hire certified, licensed local contractors (plumbers and electricians) to connect the equipment. AXAR OÜ declines all liability for water damage, electrical failures, structural damage, or poor performance resulting from improper installation or failure to meet local country building codes.

4. MEDICAL AND USAGE LIABILITY DISCLAIMER

High-temperature thermal rooms (saunas, infrared cabins, steam baths) involve extreme physical environments.

• Health Warranty: The Client and end-users are solely responsible for ensuring their physical medical compatibility (cardiovascular health, pregnancy status, blood pressure) before using any ISSGARD distributed installation.
• Exclusion of Liability: AXAR OÜ, its founder Ahmet Bozbiyik, and its confidential manufacturing partners decline all responsibility for sudden medical issues, physical burns, dehydration, or injury resulting from the usage or misuse of the equipment.

5. BESPOKE AND CUSTOM ORDERS (NO REFUND POLICY)

• Final Sales: In accordance with Article 16 of the European Consumer Rights Directive (and the Estonian Law of Obligations Act), the legal 14-day right of withdrawal for online purchases does not apply to customized goods.
• Because all premium cabins and custom layouts are manufactured tailored to the Client’s exact architectural specifications, all custom orders are 100% non-refundable, non-exchangeable, and cannot be canceled once the production deposit has been received by AXAR OÜ.

6. HARDENED B2B AND COMMERCIAL LIMITATIONS (FOR HOTELS & SPAS)

For commercial clients, hotels, public spas, and luxury resorts:

• No Lost Profits Coverage: AXAR OÜ shall never be liable for indirect, incidental, or consequential damages, including but not limited to loss of revenue, loss of hotel bookings, resort downtime, or architectural delay penalties caused by a delay in manufacturing or shipping by our industrial partners.
• Financial Cap: Under all circumstances, the total accumulated financial liability of ISSGARD (AXAR OÜ) for any validated claim is strictly capped at the exact net amount paid by the Client to ISSGARD for that specific order.

7. GOVERNING LAW AND COURT OF JURISDICTION

Any dispute, litigation, or interpretation issue regarding the sales on www.issgard.com shall be governed exclusively by the substantive laws of the Republic of Estonia.

If an amicable solution cannot be reached, the dispute shall be brought exclusively before the Harju County Court (Harju Maakohus) in Tallinn, Estonia, regardless of the Client’s nationality, shipping destination, or local residency.
